1. Purpose and Scope of Application
These Terms of Service define the rights and obligations of An Hoa Phat Co., Ltd (hereinafter referred to as “the Company”) and its customers/partners (hereinafter referred to as “the Customer”) during the process of conducting transactions, signing, and executing contracts.
These terms apply to all commercial, manufacturing, supply, and export–import activities of wooden products performed by the Company.
2. Obligations of the Company
- Provide complete and accurate information regarding products, technical specifications, pricing, delivery time, and related conditions.
- Ensure that products meet the agreed standards in terms of quantity, quality, and specifications as stated in the signed contract.
- Deliver goods on schedule and fulfill warranty obligations (if applicable).
- Maintain strict confidentiality of customer information, business documents, and contractual data.
- Promptly handle inquiries, complaints, and disputes arising during cooperation.
3. Obligations of the Customer
- Provide accurate and transparent information when placing orders or signing contracts.
- Make full and timely payment in accordance with the terms of the contract.
- Inspect the goods upon receipt and promptly notify the Company of any damages, shortages, or discrepancies.
- Do not use the Company’s trademarks, images, or documents for commercial purposes without prior written consent.
- Comply with all contractual terms and relevant legal regulations.
4. Pricing and Payment
- Product prices and any additional charges (if applicable) shall be clearly stated in the official quotation or contract.
- Accepted payment methods include bank transfer, Letter of Credit (L/C), or other forms mutually agreed upon by both parties.
- The Company reserves the right to suspend delivery or terminate the contract in case of payment default or delay by the Customer.
5. Delivery and Receipt of Goods
- Delivery schedule, location, and terms are specified in the contract.
- The Customer is responsible for arranging personnel to receive, inspect, and confirm the goods upon delivery.
- Ownership and risk of loss or damage shall be transferred according to the agreed delivery terms (e.g., FOB, CIF, EXW, etc.).
- In the event of force majeure (natural disasters, epidemics, war, strikes, etc.), the Company reserves the right to adjust the delivery time and will promptly notify the Customer.
6. Warranty and Technical Support
- The Company guarantees that its products meet declared quality standards and manufacturing specifications.
- The warranty period and conditions (if applicable) will be defined in the specific sales or supply contract.
- The Company provides technical consultation and product usage guidance within the scope of cooperation.
7. Complaint and Dispute Resolution
- All complaints must be submitted in writing via email: contact@anhoaphat.vn within seven (07) working days from the date of occurrence.
- Both parties shall first attempt to resolve disputes through negotiation and amicable settlement.
- If no resolution is reached, the dispute shall be referred to the competent Court in Ho Chi Minh City, Vietnam, in accordance with Vietnamese law.
8. Amendments and Effectiveness
- These Terms of Service may be amended or supplemented according to the Company’s internal regulations and applicable legal provisions.
- Any changes shall take effect from the official announcement date on the Company’s communication channels or upon signing a supplementary agreement between the parties.
